Terms & Conditions: 1. Acceptance The Talk2Croydon Online Community is provided free of charge to you by the Croydon Voluntary Action under these Terms of Service. By using the Talk2Croydon Online Community you are agreeing to be bound by these Terms of Service. These Terms of Service govern your use of the Talk2Croydon Online Community whether you are a member, a subscriber or a visitor and govern all services provided to you by the Talk2Croydon Online Community, including but not limited to, access to message boards and use of any e-mail accounts, and other features and services such as personal home pages, provided from time to time. If you do not agree to these Terms of Service, please do not enter the Talk2Croydon Online Community or register as a member or subscribe to our newsletters. 2. Amendments We reserve the right to amend these Terms of Service from time to time without notice to you. You will be able to access the Terms of Service throughout the Talk2Croydon Online Community. Please check the Terms of Service periodically to determine whether a change has been made to them. If you do not agree to changes in the Terms of Service as they may occur, please terminate your registration with us immediately and discontinue your use of the Talk2Croydon Online Community. Your continued use of the Talk2Croydon Online Community will signify your acceptance of any change in the Terms of Service set out here. 3. Registration When you register with us you are stating that you are over 18 years of age or are a minor with parental consent to use the service you are registering for. PLEASE NOTE that all minors are recommended to discuss these terms and conditions with their parents or legal guardian before they complete any registration process or provide us with any information about themselves. We do not allow persons who we know to be 13 years of age or younger to register with the Talk2Croydon Online Community. In return for allowing you to access the Talk2Croydon Online Community and to benefit from our services, you agree that any information you provide to us about yourself upon registration or at any other time will be true, accurate and complete and that you will ensure that this information is kept accurate and up to date at all times. 4. Password and Security When you register to use the Talk2Croydon Online Community you will be given or asked to create a password. You must keep this password confidential and must not disclose it to or share it with anyone. PLEASE NOTE that you will be responsible for all activities that occur under your password. If you know or suspect that someone else knows your password you should notify us immediately at: admin@talk2croydon.org.uk If you forget your password please contact us at admin@talk2croydon.org.uk and we will be able to remind you of your password once you have satisfied our security check. 5. Privacy Policy We treat your privacy very seriously and we understand that you will wish to know how we will use the information we collect from you. Please click here to access our privacy policy, which is incorporated into these Terms of Service. All use of your personal information will be in accordance with our Privacy Policy and will comply with all applicable UK data protection legislation. 6. Content of Messages You alone are responsible for the content of your messages and the consequences of any such messages. Croydon Voluntary Action reserves the right to restrict, suspend or terminate your registration if it becomes aware and determines, in its sole discretion, that you are violating any of the following guidelines: i. You may not use the Talk2Croydon Online Community or any subscriber's information, personal or otherwise, for any commercial purpose or to obtain direct financial gain (e.g. mass marketing). Talk2Croydon Online Community is to be used by you for your personal use only. Commercial uses of Talk2Croydon Online Community are strictly prohibited unless prior written consent from Talk2Croydon Online Community has been granted for such use. ii. The Talk2Croydon Online Community must not be used for chain letters, junk mail, 'spamming', solicitations (commercial or non-commercial) or bulk communications of any kind (including but not limited to sending messages to distribution lists) unless the recipient has given specific permission to be included in such a list. iii. The Talk2Croydon Online Community must not be used to send or distribute any message or material that is unlawful, harassing, libellous, defamatory, abusive, threatening, harmful, vulgar, obscene, profane, sexually oriented, threatening, racially offensive, inaccurate or which otherwise includes objectionable material of any kind or nature (including but not limited to, illegal material in the form of text, graphics, video, programs or audio) or that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable local, national or international law or regulation. No such message or material must be distributed or sent via Talk2Croydon Online Community or posted on message boards or placed on Talk2Croydon Online Community. Talk2Croydon Online Community reserves the right to delete any such material from Talk2Croydon Online Community. iv. You must not impersonate any other person or entity, whether actual or fictitious. v. You must not use an inappropriate member name of any kind. vi. You may not post content or participate in any form of discussion with the intention to commit any illegal activity. vii. You must not use the Talk2Croydon Online Community or any part of the Talk2Croydon Online Community in a way that might reasonably be expected to cause the same to be interrupted, damaged, rendered less efficient or which could in any way damage the operation of another's computer. 7. Intellectual Property You acknowledge that (i) the Talk2Croydon Online Community permits access to content that is protected by copyrights, trademarks and other intellectual and proprietary rights ("Rights"); (ii) these Rights are valid and protected in all media and technologies existing now or later developed; and (iii) except as explicitly provided otherwise, these Terms of Service and applicable copyright, trademark and other laws govern your use of such Rights. You may not post to the Talk2Croydon Online Community, copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer any material subject to any Rights. The burden of determining that any information, software, images or any other content on the Talk2Croydon Online Community is not protected by Rights rests with you. You acknowledge that you will not acquire any Rights by downloading any materials on Talk2Croydon Online Community. By submitting content, which shall include your member name, to any "public area" of the Talk2Croydon Online Community, including message boards, forums, contests and chat rooms, you grant Talk2Croydon Online Community and its affiliates a royalty-free, perpetual, irrevocable, non-exclusive right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any Rights that may exist in such content. You also warrant that the holder of any Rights, including moral rights, in such content (whether this is you or a third party) has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the licence stated above. You also permit any member to access, display, view, store and reproduce such content for personal use. Subject to the foregoing, the owner of such content placed on the Talk2Croydon Online Community retains any and all Rights that may exist in such content. However, the Talk2Croydon Online Community undertakes not to publish member content without informing the member. 8. Modifications of the Site The Talk2Croydon Online Community may modify or discontinue the Talk2Croydon Online Community with or without notice to you and without liability to you or any third party. 9. Termination The Talk2Croydon Online Community reserves the right, at its sole discretion, immediately, without notice to you to restrict, suspend or terminate (i) these Terms of Service; (ii) your registration with or ability to access Talk2Croydon Online Community and/or any other service provided to you by Talk2Croydon Online Community (including any e-mail account) upon any breach, or suspected breach by you of the Terms of Service (as determined in Talk2Croydon Online Community's sole discretion). The restriction, suspension or termination of our service pursuant to this section will be without prejudice to any rights which Talk2Croydon Online Community may have against you in respect of your breach of these Terms of Service. 10. Disclaimer of Warranties The Talk2Croydon Online Community is provided on an "as is" and "as available" basis. The Talk2Croydon Online Community expressly disclaims all warranties or representations of any kind, express or implied, to the fullest extent permitted by law. You understand and agree that the Talk2Croydon Online Community does not guarantee the accuracy or completeness of any information in or provided in connection with Talk2Croydon Online Community. Talk2Croydon Online Community is not responsible for any errors or omissions or for the results obtained from the use of such information. The information is provided with the understanding that neither Talk2Croydon Online Community, its employees or consultants or its members, while such members are participating in Talk2Croydon Online Community, are engaged in rendering legal, medical, counselling or other professional services or advice. Talk2Croydon Online Community encourages you to seek appropriate professional advice or care for any situation or problem which you may have. The Talk2Croydon Online Community shall not be responsible for any loss or damage caused, or alleged to have been caused, directly or indirectly, by the information or ideas contained, suggested or referenced on Talk2Croydon Online Community Connect. Your participation in Talk2Croydon Online Community is solely at your own risk. No advice or information, whether oral or written, obtained by you from Talk2Croydon Online Community or through Talk2Croydon Online Community shall create any warranty not expressly made in these terms of service or imposed by law. 11. Limitation of Liability To the fullest extent permitted by law the Talk2Croydon Online Community shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use Talk2Croydon Online Community or messages received or transactions entered into through Talk2Croydon Online Community or resulting from unauthorised access to or alteration of your transmissions or data even if Talk2Croydon Online Community has been advised of the possibility of such damages. 12. Remedies for Breach of these Terms by You In the event that the Talk2Croydon Online Community determines, at its sole discretion, that you have breached any portion of these Terms of Service, or have otherwise demonstrated conduct inappropriate to the Talk2Croydon Online Community, Talk2Croydon Online Community reserves the right to (i) warn you via e-mail that you have violated these Terms of Service; (ii) delete any content provided by you or your agent(s) to Talk2Croydon Online Community, (iii) discontinue your registration with Talk2Croydon Online Community (iv) notify and/or send content to and/or fully cooperate with the proper law enforcement authorities and/or agencies for further action; and/or (v) take any other action which Talk2Croydon Online Community deems to be appropriate. 13. Indemnification You agree to indemnify and hold each of the Talk2Croydon Online Community, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of Talk2Croydon Online Community, the violation of these Terms of Service by you, or the infringement by you, or any other subscriber of your account, or of any intellectual property or other right of any other person or entity. 14. Applicable Law These Terms of Service shall be governed by and construed in accordance with the laws of England.
